TERMS AND CONDITIONS OF USE

THIS SERVICE INCLUDES SUBSCRIPTIONS THAT AUTOMATICALLY RENEW.

Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the CATENARY CABLES mobile application (the "Service") operated by EnergyLink LLC ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all users of the Service.

By subscribing, accessing, or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Subscription and Billing

The Service is available as a monthly or yearly subscription. By subscribing to the Service, you agree to pay the subscription fees indicated for the selected plan. All fees are non-refundable.

Payment will be charged to your iTunes Account at confirmation of purchase. Your subscription will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current subscription period. Your account will be charged for renewal within 24 hours prior to the end of the current period, at the subscription price indicated.

You may manage your subscription and turn off auto-renewal by going to your Account Settings after purchase.

2. Intellectual Property

All content within the Service, including but not limited to, text, images, graphics, software, and logos, is the property of EnergyLink LLC or its content suppliers and protected by copyright and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from the Service's content without the express written permission of EnergyLink LLC.

3. Limitation of Liability

In no event shall EnergyLink LLC, its employees, agents, partners, or licensors be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, or goodwill, resulting from (i) your access to or use of, or inability to access or use, the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed its essential purpose.

4. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

EnergyLink LLC does not warrant that a) the Service will function uninterrupted, secure, or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.

5. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.

6. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

7. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach the Terms. Upon termination, your right to use the Service will cease immediately.

You agree to defend, indemnify, and hold harmless EnergyLink LLC, its affiliates, licensors, and their respective directors, officers, employees, and agents from and against any and all claims, actions, demands, damages, costs, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service or your violation of these Terms.

8. User-Generated Content

You retain ownership of any content that you submit or post through the Service, including text, images, and other materials (\"User-Generated Content\"). By posting or submitting User-Generated Content, you grant EnergyLink LLC a non-exclusive, royalty-free, worldwide, perpetual, irrevocable, and sublicensable right to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in any media.

You represent and warrant that you have the necessary rights to grant the above license to any User-Generated Content you submit or post and that EnergyLink LLC's use of such content does not infringe or violate the intellectual property rights of any third party.

Please review our Privacy Policy, which also governs your use of the Service and is incorporated by reference into these Terms, to understand our practices regarding the collection, use, and disclosure of personal information.
